BY PLACING YOUR ORDER YOU ARE ACCEPTING THESE TERMS & CONDITIONS.

This is your consent to allow Memories & Memorials to create your floral preservation using their best judgment and discretion based on your display selection and any written direction provided by you. Floral preservation is custom work and subject to creative decisions made at the design stage. You have given us permission to make these decisions on your behalf. Once your preservation is complete any changes or alterations requested by you may create additional charges for labor, materials, and shipping. You understand that major changes may not be possible without damage to your flowers. All floral preservation must include a display selection.

Custom Work/Design Decisions
The quality and condition of your flowers will affect the quality of your preserved flowers. Memories & Memorials does not assume liability for any damages to your flowers prior to their arrival at our Design Center. All flowers accepted and preserved by Memories & Memorials becomes our property until all charges associated with preservation and the display are paid in full. You agree that Memories & Memorials can use its best judgment as to which or how many flowers, if any, need replacement and that you will pay reasonable charges (no more than $20.00 without your approval) to cover replacement cost. In the event that a filler flower or greenery does not preserve well, we will replace it with a like product, either preserved or artificial. It is the customer's responsibility to confirm that the display ordered is correct, including the style, color and size. Changes to display choices can result in additional charges.

Payment/Timetable
Reservation deposits are not refundable for any reason. Your final display decision must be made no later that three weeks following the receipt of flowers and the balance paid in full unless a payment plan is selected. A late fee of $25.00 will be charged on final orders/payments made after this time. In addition a $25.00 late fee will be charged monthly until paid. While we will make every effort to contact the client, it is the client's responsibility to make this payment, with or without notice. If a display decision/payment is not made nor a payment plan established we reserves the right to depose of the flowers with out notice after three months. Returned checks for payments of any kind will be charged a fee of $50.00. Preservation will be completed 16-18 weeks in most cases. We retain the right to extend this timetable if required. When possible the client will be given notice of delays.

Payment Plans
Payment plans must be established on the same three-week time frame per the above. A payment plan setup fee will be charged and is payable with the first payment. A Late fee of $5.00 per day will be billed to your account on payments that are made past the due date. More than two late payments will require the full balance be paid in full, at once. Design work is not completed on payment plans until the total cost is paid in full. Once paid it will be completed per a new schedule and may take 8 to 12 weeks or more to complete.

Delivery/Shipment of Completed Preservation
Once the preservation is complete it will be shipped (if shipping has been contracted for) by UPS ground to the address provided by the customer. It is the customer's responsibility to advise the company of address and phone number changes. Re-shipments will be charged to the customer. The company assumes no liability for displays/preservation shipped by the customer. If requested, we will hold the completed preservation at the Design Center for customer pickup. The customer will be provided notice by phone. The completed preservation will be held for up to four weeks at no charge. After this time a storage fee of $5.00 per day will be charged. Completed preservation not picked up three months after the customer has been provided with notice will be considered abandoned and becomes the property of Memories & Memorials.

If you are unhappy with your preserved flowers for any reason you have 30 days, after receipt of your preservation, to request a refund. Refunds are limited to the purchase price, less shipping, and the non-refundable deposit or other service charges. It is the client's responsibility to return the display, in good condition, and to cover any shipping charges required to do so. The refund will be issued once the display and flowers are returned to our design center. The long-term condition of your preserved flowers is dependent on factors beyond our control and therefore no guarantees or refunds are made beyond the 30-day period. Memories & Memorials is not responsible for and cannot repair flowers that have been infected by insects. The laws of Texas will govern this agreement and any dispute must be settled in Dallas County. Memories & memorials is a DBA by Dream Dresses LP located in Dallas County.
